Managing debt

Here's the honest version. The debt is still yours, and the balance can grow. Below is what actually happens after a missed payment, what to do this week, and how to pay it off without borrowing your way into a bigger hole.
The short answer
- Walang kulong dahil lang sa utang. Not paying a debt is generally a civil matter. Fake documents and bounced checks are a different story.
- The balance can grow, pero may cap. For covered small loans, late penalties top out at 5% a month and all charges together can't pass 100% of what you borrowed.
- Collectors have rules. No threats, no insults, no posting your name, no texting people in your phone who aren't your co-makers or guarantors.
- Your CIC record can take a hit. Negative data stays for up to 3 years after you pay or settle, so the clock only starts once you fix it.
- The lender can sue. Usually through a small claims case. A demand letter isn't a court case, but a real court summons is something you answer.
- A new loan helps only if the total is lower. SSS and Pag-IBIG loans cost far less than an app, if you qualify.
Charges first, then collection, then the credit record, and in some cases, court.
Penalties at dagdag na singil
Start with the paperwork. Under the Truth in Lending Act (RA 3765), the lender had to disclose the finance charges before you took the loan.
Then check if your loan is covered by SEC Memorandum Circular No. 14, series of 2025. It applies to unsecured, general-purpose loans from lending and financing companies of ₱10,000 or less, with terms up to 4 months, entered into, restructured or renewed from 1 April 2026. For those loans:
| What's capped | Ceiling |
|---|---|
| Nominal interest | 6% a month (about 0.2% a day) |
| Interest plus all fees (effective interest rate), not counting late penalties | 12% a month (about 0.4% a day) |
| Late payment or non-payment penalty | 5% a month on the overdue scheduled amount |
| All interest, fees, charges and penalties together | 100% of the amount borrowed, no matter how long it's been unpaid |
Example (our math using the caps): you borrowed ₱5,000 for one month on a covered loan. The most a compliant lender can charge in interest and fees is ₱600, so on time you'd pay up to ₱5,600. If you don't pay and it keeps running, all the charges together still can't go past ₱5,000. So ₱10,000 is the legal maximum on that loan, kahit ilang buwan pa itong hindi nabayaran.
Loans above ₱10,000 or longer than 4 months aren't covered by these caps, so for those the contract and the disclosure statement are what you check. The SEC also said that restructuring or repackaging a loan, or disguising fees, to get around the caps may count as a separate violation. Kung ang "restructured" balance mo ay biglang mas mataas sa cap, ask them to recompute. Our EIR and fees explainer shows how to read the numbers.
Reminders, tawag at text mula sa collector
Expect reminders from the app first, then calls and texts, sometimes from a collection agency the lender hired. That's allowed. Collecting a real debt is legal.
Ask which company they're from and for a written breakdown of the balance, then check it against what the app itself shows. Fake collectors exist because people in your situation are scared and in a hurry.
Ang credit record mo sa CIC
Under the Credit Information System Act (RA 9510), banks, credit card companies and other lenders submit credit data to the Credit Information Corporation (CIC). Past due accounts and defaults count as negative information.
Ang hindi alam ng marami: negative information stays for not more than 3 years after it's rectified, meaning after you pay or settle it through a compromise agreement or a court decision. Habang hindi bayad, hindi tumatakbo ang 3 years. Deleting the app doesn't change anything either. The CIC also says a record should be updated within 15 days after it gets notice of your payment or settlement, so keep your proof. For how to get your own report and fix it, see our page on loan kahit may bad credit.
Demand letter at small claims case
If you stay unpaid, a lender may send a demand letter, and it can file a case to collect. For loans, that's usually a small claims case. Under the Supreme Court's Rules on Expedited Procedures in the First Level Courts, small claims cover purely money claims of up to ₱1,000,000 (not counting interest and costs), including money owed under a loan.
These are filed in the first level courts: the MeTC, MTCC, MTC or MCTC. Lawyers generally can't appear as counsel. You appear yourself, and the company sends an authorized representative.
Two things to keep straight. A demand letter is not a court decision, kahit gaano ka-formal ang itsura. Read the instructions and show up, because that's where you can raise wrong charges.
The 1987 Constitution, Article III, Section 20 is short and clear: "No person shall be imprisoned for debt or non-payment of a poll tax." Not paying a loan is a civil matter, so don't panic when a collector says "may warrant ka na". Under SEC rules, threatening action that can't legally be taken is itself an unfair collection practice.
Two situations are different:
- A postdated check that bounced. Batas Pambansa Blg. 22 punishes issuing a check without enough funds that the bank later dishonors. The penalty is 30 days to 1 year of imprisonment, or a fine of up to double the check amount (never more than ₱200,000), or both, at the court's discretion. This applies only if you actually gave the lender a check.
- Fake documents or a fake identity. Using these to get a loan is a separate matter from simply not paying.
Kung isa sa dalawang ito ang sitwasyon mo, talk to a lawyer or the Public Attorney's Office (PAO) about your actual documents.
Ano ang bawal gawin ng collector
SEC Memorandum Circular No. 18, series of 2019 covers lending and financing companies and the third-party collectors they hire. Bawal sa kanila ang:
- violence, or threatening it
- threatening action that can't legally be taken
- insults, obscenities and profane language
- publishing your name and details as a non-payer, like shaming posts
- telling others false information about your loan, including not saying that you're disputing it
- lying or using fake identities to collect
- contacting people in your phone who aren't your named guarantors or co-makers, even if you allowed contact access
There's also a rule on hours: no contact before 6:00 a.m. or after 10:00 p.m. That protection ends once the account is more than 15 days past due, or if you expressly agreed to those times. Even then, the other rules above still apply.
Screenshot everything, with the date and time visible. Our guide on loan app harassment and your rights explains how to file with the SEC (unfair collection), the National Privacy Commission (misuse of your data and contacts) and the PNP-ACG or NBI (threats or extortion).
Talking to the lender before the charges pile up beats waiting for the collector to call.
- Ipunin ang records. Contract, disclosure statement, screenshots of the balance, receipts, and every message with its date.
- Kwentahin muna ang essentials. Food, rent, light and water, pamasahe papunta sa trabaho. What's left after that is what you can honestly offer.
- Humingi ng itemized balance. Principal, interest, fees and penalties, each on its own line. If your loan is covered by the caps, check the total against them.
- Mag-propose ng schedule na kaya mo. If you're paid on the 15th and 30th, time the hulog to your kinsenas and katapusan. Don't promise money you don't have yet.
- Kunin ang kasunduan in writing. The total, the due dates, and what happens to the remaining charges. Until they accept in writing, it's just a proposal.
- Magbayad sa official channel lang. Use the payment options inside the app or on the lender's own site. Never a collector's personal GCash or Maya number. When it's done, ask for a written settlement or a certificate of full payment.
Keep it calm and short.
Refinancing means taking a new loan to pay off the old one. It only makes sense if the new loan costs less in total and the new hulog actually fits your budget. Kausapin muna ang lender mo ngayon tungkol sa payment arrangement, then look at the options below, from cheapest. Our refinance page puts consolidation options side by side.
SSS loans
The interest is a fraction of what apps charge.
- SSS LoanLite: ₱1,000 to ₱20,000 for 15, 30, 60 or 90 days at 8% a year (about 0.67% a month). You need at least 12 posted contributions and no past-due SSS short-term loan. You apply inside a participating bank app. SSS has confirmed UnionDigital Bank, and RCBC says DiskarTech has it. A loan app debt isn't among the conditions. Details in our SSS LoanLite guide.
- SSS Emergency Loan: up to ₱20,000 at 7% a year with no service fee. You need 18 posted contributions, 6 of them in the last 12 months. It's paid over 30 months: a 6-month moratorium, then 24 monthly amortizations. SSS says applications are open until 30 April 2027. Late amortizations get a 1% a month penalty, so don't fix one late loan by creating another. See our SSS Emergency Loan guide.
- SSS Salary Loan: for members with 36 posted contributions, 6 of them in the last 12 months.
Meeting the contribution rules isn't the same as approval. SSS checks your records first.
Pag-IBIG Multi-Purpose Loan
The Pag-IBIG MPL is based on your Total Accumulated Value, meaning your Pag-IBIG savings. You need at least 12 monthly savings posted, and terms are 12, 24 or 36 months. A defaulted Pag-IBIG loan blocks you, so kung may naka-default ka na sa Pag-IBIG, ayusin muna 'yon. Our Pag-IBIG and SSS loans overview compares the two.
Bank personal loan o debt consolidation
If you have several debts, a consolidation loan from a bank replaces them with one payment. Ask for the disclosure statement and compare the new total repayable with what you owe now. A longer term can mean you pay more overall. Our utang page has more on consolidation.
If even the new hulog won't fit, go back to negotiating with the lender you already owe. Changing lenders doesn't fix a budget that doesn't close.
If government loans aren't an option, an SEC-registered lender is the next step. Three partners on our list:
- MoneyCat: MoneyCat Financing Inc., SEC Reg. No. CS201953073, CA No. 1254. Its site states ₱500 to ₱20,000, up to 180 days, with a maximum APR of 145%.
- Finbro: Sofi Financing Inc., SEC Reg. No. CS201908275, CA No. 1324. Its site states ₱1,000 to ₱50,000 for new clients.
- Finmerkado: FinMerkado Inc., SEC Reg. No. 2024120180322-17. It's a loan-matching platform, not a lender, and its partner lenders set the terms.
Walang guaranteed approval sa kahit alin dito. And a loan app at 145% APR is not a cheap way to pay off another loan app. Before you accept anything, compare the total repayable on our lender comparison and the low-interest loan apps ranking.
It's the same debt with new fees on top, and a second app watching your due date. Even a loan with monthly installments has to fit after your essentials. If it doesn't, stop and negotiate first.
Isulat sa isang papel o spreadsheet ang bawat lender: principal, current balance, charges, due date, and what you plan to offer. Mark the charges you think are wrong, para malinaw kung ano ang ipapa-recompute mo.
Then divide one budget across all of them. Don't hand all your cash to whoever shouts loudest. The scariest collector isn't automatically the most important debt. Make every offer from the same numbers so you don't promise the same sweldo twice, and keep each written agreement and receipt per account.
Red flags: fake collectors at "debt relief" scams
People behind on loans get targeted. Walk away if you see:
- A personal wallet for payment. "Sa GCash ko na lang i-send" from someone who can't show you the account in the app.
- No breakdown. A collector who won't say how the balance was computed.
- Promises to erase your CIC record for a fee. Correct negative data stays until the rules say it goes.
- A deadline "within the hour" in a chat. Pressure is the scam.
- An app or page that copies a real lender's name. The SEC has warned about fake apps using the names of registered lenders.
A legit lender shows its corporate name, SEC Registration No. and Certificate of Authority No., and its app is on the SEC List of Recorded Online Lending Platforms. May SEC ba? Check it with our guide on how to check if a lender is SEC-registered, and confirm any settlement through the lender's official channel before you pay.

The Constitution says no person shall be imprisoned for debt, and not paying a loan is a civil matter. A bounced postdated check under B.P. 22 or using fake documents to get the loan are separate matters. The lender can still file a civil case to collect.
Penalties get added, collectors will call and text, and your CIC record can show the default. If it stays unpaid, the lender may send a demand letter or file a small claims case. For covered loans of ₱10,000 or less from April 2026, all charges together can't pass 100% of what you borrowed.
SSS LoanLite needs at least 12 posted contributions and no past-due SSS short-term loan, and a loan app debt isn't one of its conditions. Compare the new total and schedule before you use it to pay off the app.
Up to 3 years after you pay it or settle it through a compromise agreement or a court decision. Keep your proof of payment, because the CIC says the record should be updated within 15 days after it receives notice.
